The Declaration of Conformity is one of the key documents for any product. It is the first thing that state supervisory authorities check during inspections. Pay attention to how this document should be properly prepared.

Declaration without an artificial expiry date

Problem 1

Invalid declaration

Most companies write a fixed expiry date into the declaration — one, two or three years. If a technical regulation changes within that period, the document can become invalid before its stated expiry. That is a risk during a market surveillance inspection.

Unnecessary annual costs

Annual renewal of a declaration is an extra cost with no legal necessity. Ukrainian legislation does not require an artificial validity limit on a declaration of conformity.

Clarification from the Ministry of Economy

Mandatory registration of a declaration is not required

The Ministry of Economy clarified in response to UKRCERT's request: a declaration of conformity is drawn up by the manufacturer or its authorised representative in the cases defined by technical regulations. The law does not impose a duty to register such a declaration in state or private registers.

“The law does not provide for mandatory registration of a declaration of conformity.”

Therefore, a declaration without registration is a complete document if it is prepared correctly and meets the requirements of the applicable technical regulation. Registration can be an additional service for convenience or presentation, but it is not a condition for the declaration's legality.

Step-by-step procedure for preparing a declaration of conformity

Product and regulations identification

Based on the product name, UKT ZED code and intended use, we determine the list of applicable technical regulations. An error at this step means the declaration is drafted against the wrong requirements.

Selection of conformity assessment module

Module A is the simplest: the manufacturer self-checks the product and signs the declaration. Higher-risk products (Category III PPE, ATEX) require a notified body.

Preparing the technical file

The technical file documents conformity: product description, test reports, list of DSTU / EN standards, operating instructions. Kept by the manufacturer and provided upon request by market surveillance.

Drafting and signing the declaration

The form is defined by the technical regulation. The declaration includes: manufacturer name and address, product description, list of regulations and standards, signature of the authorised person.

Affixing the conformity marking

The product receives the national conformity mark for the Ukrainian market, or CE marking — for supply to EU countries.

Declarations for importers and EU suppliers

Imports to Ukraine

Products covered by technical regulations require a Ukrainian-format declaration. The technical file may rely on test reports from foreign laboratories accredited to ISO/IEC 17025 — repeat testing is not required.

Supply to the EU

CE marking and a declaration to EU directives are required. The technical file can be shared: the same reports confirm compliance with both Ukrainian and European requirements when standards are harmonised.

What is a declaration of conformity?

A declaration of conformity is a document in which the manufacturer or authorised representative confirms that a product complies with the requirements of Ukrainian technical regulations. By signing the declaration, the manufacturer assumes full responsibility for the product's conformity.

Which products require a declaration of conformity?

A declaration is required for products covered by Ukrainian technical regulations: low-voltage electrical equipment, electromagnetic compatibility, machinery, measuring instruments, toys, PPE, radio equipment and other categories.

What is the difference between a declaration and a certificate of conformity?

A declaration is issued by the manufacturer or its authorised representative. A certificate is issued by an accredited conformity assessment body based on an independent verification. For most products covered by technical regulations, a declaration is required — not a certificate.

How long does it take to prepare a declaration of conformity?

Standard processing time — up to 2 business days from the moment full product and manufacturer data is provided. In urgent cases, a scanned declaration can be issued within 2 hours.

Is registration of the declaration of conformity required?

No. The Ministry of Economy officially confirmed that Ukrainian legislation does not require declarations of conformity to be registered in state or private registers. Registration is an optional service, not a legality condition.

How long is a declaration of conformity valid?

Legislation does not impose a mandatory validity period. UKRCERT issues declarations without a calendar limit: the document remains valid as long as the product and the technical regulation requirements have not changed.

What is the liability for placing products on the market without a declaration of conformity?

If a product is covered by a technical regulation, it must not be placed on the Ukrainian market without a declaration of conformity. Market surveillance may lead to fines, sales bans or withdrawal from the market, and customs detention of shipments. If the product causes harm to a consumer, the manufacturer or importer bears full liability.
