The Cabinet of Ministers of Ukraine approved the new Machinery Technical Regulation by Resolution No. 1630 of 10 December 2025. The resolution enters into force on 20 January 2027 and replaces the current Technical Regulation on Machinery Safety approved by Resolution No. 62 of 30 January 2013.
One of the important practical changes concerns the declaration of conformity. The manufacturer must ensure that machinery or related products are accompanied by a declaration of conformity. Alternatively, the instructions for use and the information referred to in Annex 3 to the regulation may include an internet address or a machine-readable code through which the relevant declaration can be accessed.
This means that the declaration may be made available in electronic form. The regulation does not use the narrow term “QR code”, but the broader concept of a “machine-readable code”. A QR code may be one technical way to implement this requirement, but it is not the only possible option.
Declarations of conformity provided in electronic form must remain available online for the expected lifetime of the machinery or related product and for at least 10 years after the product has been placed on the market or put into service.
Importantly, this requirement applies specifically to products covered by the new Machinery Technical Regulation — machinery, related products and partly completed machinery. It should not be interpreted as a general requirement for all CE-marked products or for all declarations of conformity.
For manufacturers, importers and suppliers of machinery, this means that declaration templates, instructions for use and technical documentation storage systems should already be reviewed. If a company plans to provide declarations through an internet address or machine-readable code, it must ensure stable online document storage, version control and availability of the declaration for the required period.
