Ukraine’s Parliament Adopts Law on State Market Surveillance: What Changes for Citizens and Business

The Verkhovna Rada adopted European integration Law No. 12426 to improve state market surveillance and the technical regulation system.

The law is aimed at strengthening product safety control

On April 8, the Verkhovna Rada adopted European integration Law No. 12426 on improving state market surveillance and the technical regulation system in line with EU law.

According to the parliament, implementation of the law is expected to increase the effectiveness of product safety control on the market and strengthen liability for violations of established requirements.

Why this matters for European integration

The document is considered one of the elements of Ukraine’s preparation for the Agreement on Conformity Assessment and Acceptance of Industrial Products — ACAA. Such an agreement should bring Ukraine’s technical regulation system closer to EU rules and create conditions for easier access of Ukrainian industrial products to the European market.

For manufacturers, this increases the importance of technical documentation, declarations of conformity, labelling and evidence supporting product safety.

What changes for citizens and business

For consumers, the law should strengthen protection against dangerous and low-quality products. The state receives additional tools to respond to consumer complaints and control products already placed on the market.

For businesses, more uniform competition rules are expected. Market surveillance should apply not only to traditional stores, but also to products sold through online platforms and marketplaces.

What manufacturers and importers should pay attention to

Companies should check whether their products comply with applicable technical regulations and whether the declaration of conformity, technical documentation, instructions and labelling are properly prepared.

Stronger market surveillance means that the formal availability of documents may not be enough: the documents should match the actual characteristics of the product and be able to confirm its safety.
